Personal information does not include information that is anonymized or de-identified so that it cannot identify or be reasonably linked to you.

We do not store full credit card numbers — payment data is processed securely through our payment providers.

Depending on how you interact with the Services, we may use your personal information for the following purposes:

We do not sell, rent, or trade your personal information to third parties for their own marketing purposes. We may disclose your personal information to third parties only in the following circumstances:

 

       Service providers: with vendors and other third parties who perform services on our behalf, such as payment processing, data analytics, customer support, cloud storage, fulfillment, and shipping.

       Business and marketing partners: to provide marketing services and advertising to you, including through Meta platforms. Depending on where you reside, you may have a right to opt out of sharing your information for targeted advertising purposes (see Section 8).

       With your direction or consent: when you direct, request, or otherwise consent to our disclosure of certain information to third parties.

       Business transactions: in connection with a merger, sale, or acquisition. We will notify you of any such change and your available choices.

       Legal requirements: to comply with applicable legal obligations, respond to subpoenas or similar legal requests, and protect or defend the rights of RefinedByJV, our customers, or others.

5. Relationship with Shopify

The Services are hosted by Shopify Inc., which collects and processes personal information about your access to and use of the Services in order to provide and improve those Services for you. Information you submit through the Services will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside.

6. Data Storage, Retention, and Cross-Border Transfers

6.1 Data Storage

RefinedByJV is based in British Columbia, Canada. Your personal information is primarily stored and processed in Canada through Shopify's infrastructure. However, some of our service providers — including Shopify and Meta — operate servers located in the United States and other countries. By using our Services, you acknowledge and consent to the transfer of your information outside of Canada.

 

We take reasonable contractual and technical steps to ensure that any cross-border transfers of personal information are protected appropriately.

6.2 Data Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including to provide our Services, comply with legal obligations, resolve disputes, and enforce our agreements.

 

Order information is typically retained for a minimum of seven (7) years in accordance with Canadian tax and accounting requirements.

 

If you unsubscribe from marketing communications, we will remove you from active marketing lists but may retain a record of your email address and unsubscribe request to honor your preference and comply with CASL.

7. Email and Marketing Communications (CASL)

We send commercial electronic messages (CEMs) — including promotional emails, newsletters, and marketing offers — only with your express or implied consent, as required by Canada's Anti-Spam Legislation (CASL).

 

Express consent means you have actively opted in to receive marketing communications from us.

 

Implied consent may apply where you have made a purchase from us within the preceding two (2) years, or have made an inquiry within the preceding six (6) months, in accordance with CASL.

 

Every marketing communication we send will include our name and contact information, and a clear, easy, and free mechanism to unsubscribe from future messages.

 

You may opt out at any time by clicking the unsubscribe link in any of our emails, or by contacting us at hello@refinedbyjv.com. We will process all unsubscribe requests within ten (10) business days, as required by CASL.

 

Opting out of marketing communications will not affect your receipt of non-promotional communications necessary for your orders, such as order confirmations and shipping notifications.

8. Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below regarding your personal information. We will not discriminate against you for exercising any of these rights.

8.1 Right of Access / Right to Know

You may request access to the personal information we hold about you. We will respond within thirty (30) days of a valid written request.

8.2 Right to Correct

You have the right to request that we correct personal information we hold about you that is inaccurate or incomplete.

8.3 Right to Delete

You may request that we delete personal information we maintain about you, subject to our legal retention obligations.

8.4 Right of Portability

You may have the right to receive a copy of the personal information we hold about you in a structured, commonly used format, and to request that we transfer it to a third party, subject to applicable exceptions.

8.5 Right to Withdraw Consent

You may withdraw your consent to our collection, use, or disclosure of your personal information at any time, subject to legal or contractual restrictions and reasonable notice.

8.6 Right to Opt Out of Targeted Advertising

Depending on where you reside, you may have the right to opt out of the processing of your personal information for targeted advertising purposes. If you visit our Site with the Global Privacy Control (GPC) opt-out preference signal enabled, we will treat this as a request to opt out for the specific device and browser you are using. 8.7 Managing Communication Preferences

You may opt out of marketing communications at any time using the unsubscribe option in our emails. Non-promotional messages such as order confirmations and customer service responses will continue.

8.8 Additional Rights for California Residents (CCPA)

If you are a resident of California, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know, the right to delete, the right to opt out of the sale of personal information (we do not sell personal information), and the right to non-discrimination. As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" the personal information of individuals under 16 years of age.

You may designate an authorized agent to make privacy rights requests on your behalf. We will require proof of authorization and may verify your identity directly before processing such requests.

9. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to improve your browsing experience, remember your preferences, and understand how visitors interact with the Site.

 

       Essential cookies: required for the Site to function. These cannot be disabled.

       Analytics cookies: used to understand how visitors use the Site.

       Marketing cookies: used to serve relevant advertising, including through Meta Pixel technology.

10. Children's Data

The Services are not intended to be used by children. We do not knowingly collect personal information from anyone under the age of majority in their jurisdiction. In British Columbia, the age of majority is 19 years.

As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" the personal information of individuals under 16 years of age.

The Services may contain links to websites or online platforms operated by third parties. We are not responsible for the privacy or security of third-party sites, and our inclusion of such links does not imply any endorsement of their content.

 

Information you share on third-party social networking platforms may be viewable by other users of those platforms without limitation as to its use by third parties.

12. Security of Your Information

We implement reasonable administrative, technical, and physical safeguards to protect your personal information. However, no security measures are perfect or impenetrable, and we cannot guarantee absolute security.

 

We recommend that you do not use unsecured channels to communicate sensitive or confidential information to us.

13. Do Not Track and Global Privacy Control

If you visit our Site with the Global Privacy Control (GPC) opt-out preference signal enabled, we will treat this as a request to opt out of targeted advertising for the specific device and browser you are using. Other than the Global Privacy Control, we do not currently alter our data collection practices in response to other "Do Not Track" signals.
